Firm Partners Co-Author Groundbreaking New Book on Arizona Probate and Trust Law

We are proud to announce the publication of a new legal resource authored by three of our own: Mark House, Andrea Burnett O’Neill, and Amanda Barney. Their new book, Arizona Probate and Trust Administration and Litigation with Forms, co-authored with Nora Jones of Tiffany & Bosco, P.A., is now available through leading legal publisher Matthew Bender.

This comprehensive volume offers far more than a summary of Arizona’s probate and trust laws. Rooted in decades of combined legal experience, the book provides both practical guidance and deeper legal context, making it an indispensable tool for estate and trust practitioners across the state.

What sets this book apart is its dual focus: it serves as both a “how-to” guide—complete with essential forms—and an analytical resource that explores the evolution and future trajectory of probate and trust law in Arizona. The authors recognize that the law in this area is anything but static. As they write in the preface, “The past 100 years has seen quantum shifts in the law, and there is little reason to believe that we have reached our final destination.” By offering context for how the law has developed over time, the authors aim to help practitioners not only understand where the law is today, but anticipate where it may be headed next.

This perspective is especially valuable in an era where legal systems are still catching up to societal change. From pet trusts and dynasty trusts to questions involving non-traditional family structures and same-sex couples, Arizona Probate and Trust Administration and Litigation with Forms tackles the complex and sometimes unsettled areas of practice that attorneys face every day. The book also includes comprehensive analysis on intestacy and Arizona’s nuanced departure from the Uniform Trust Code, offering critical insight into how statutory schemes interact—and sometimes conflict.

To celebrate the publication, the authors hosted a book launch event on April 11, 2024. Colleagues, friends, and members of the legal community gathered for an evening of recognition and conversation in downtown Phoenix. The event highlighted the collaborative spirit behind the book and honored the authors’ hard work and dedication to the Arizona legal community.
